SHARON ZONING BOARD OF APPEALS

MINUTES OF JANUARY 23, 2008

A regular meeting of the Town of Sharon Zoning Board of Appeals was held on Wednesday, January 23, 2008 at 8:00 P.M. in the Town Office Building, Lower Level.  The following members were present:  John Lee, Chairman; Kevin McCarville, Walter Newman, Larry Okstein, and Seth Ruskin.

Mr. Lee called the meeting to order at 8:00 P.M.

Minutes:  Mr. McCarville moved to accept the minutes of December 12, 2007 and December 20, 2007 as presented.  Motion seconded by Mr. Ruskin and voted 3-0-0.

Gary Klein, Case No. 1604:  Mr. Klein had requested that this hearing be continued.  Mr. Newman moved to continue this hearing without testimony to February 27, 2008 as requested by Mr. Klein.  Motion seconded by Mr. McCarville and voted 3-0-0.  Mr. Lee signed the extension of time and asked that Mr. Klein be contacted to do likewise.

TKG Fitness, Case No. 1602:  Mr. Lee stated that anything that is requested for this hearing ; i.e., copies, minutes, etc., needs to be done so in writing.  The Board agreed. 

The Board agreed there was a clerical correction in the TKG Fitness decision.  A new page was to be submitted to the Town Clerk reflecting the change in Condition #7, Page 3.  It was agreed that Condition #7 should read:  “Access cards with a pin number of six or more characters shall be used as a two-step authentication system”.

Simpson Housing, Case No. 1573 Continued Hearing:  Mr. McCarville moved to close the public hearing.  Motion seconded by Mr. Okstein and voted 3-0-0 (Lee, McCarville, Okstein). 

Mr. McCarville moved to deny the application for Simpson Housing.  Motion seconded by Mr. Okstein and voted 3-0-0 (Lee, McCarville, Okstein).

Mr. Lee stated that town counsel will review the final decision before it is filed with the town clerk.  He stated that this application was denied because of safety and environmental concerns.

Guttierez, Carriage Lane and Old Post Road, Case No. 1592:  Mr. McCarville moved to close the public hearing.  Motion seconded by Mr. Okstein and voted 3-0-0 (Lee, McCarville, Okstein).

Mr. McCarville moved to deny the application for Guttierez.  Motion seconded by Mr. Okstein and voted 3-0-0.

Mr. Lee stated that town counsel will review the final decision before it is filed with the Town Clerk.  He stated that this application was denied because of safety and environmental  concerns .

It was moved, seconded and voted to adjourn.  The meeting adjourned at 8:30 P.M.
